Legal Question in Family Law in California
How do I get an illegally obtained court reversed or dropped?
I was going through a tough separation/divorce and after repeated requests to my family for help, they offered to watch my two girls while I got things straightened out. They gave me a month. I agreed. However, two weeks after I left my girls in their care, my mom called me to say I had two days to get back to the state and show up in court if I wanted my girls back. That was not possible as I was a few states away and broke. My mom filed a petition for guardianship claiming I was a drug addict and alcoholic who had abandoned my children, had claimed I didn't want my children and that they didn't know where I was. Since I wasn't able to make it to court on such short notice, I had no way of defending myself (everything avowed in the petition was completely false) and guardianship was granted to my parents. They have since refused to drop guardianship themselves, and have threatened the police if I were to show up. The worst part is, my parents dont even have my children; they pawned them off on my brother and his family who have been telling my girls some messed up stuff, and now are threatening to not even let me talk to their girls. I have no legal resources, knowledgeably, monetarily, or otherwise. I desperately want my babies back.

File a motion to terminate the guardianship and have the children returned to your custodial care.
