Legal Question in Family Law in California

We want to immancipate our minor child, 17 yr. old male.

How do we go about filing to imancipate our minor child. We want him out of the house and no longer want to be responsible for him. He is on drugs and very irrational behavoir that has been detrimental to our other children in the home. What are the consequees of this? Thank you Kat.

There is a form that is filled out by the minor and filed with the court. If the judge signes it then the minor is emancipated. However, the minor must be able to show that he or she has the ability to support themself. It is unlikely that the judge will sign the emancipation order.

You need to get professional help in dealing with this situation. It may be necessary for you to call the police and get them involved in the situation. It is probable that he will be treated as a juvenile and referred to a drug treatment program.

Emmancipation is not something that can be forced upon a minor; it is a legal request by a minor to be treated as an adult. Your situation is a very difficult one and, although it does have legal overtones, is more suited for a therapist who deals in this area. Good luck.

Emancipation is something requested and sought by the child--he can do it if he wishes. If not, you may want to explore other options, like counseling, social services, or even contacting the police.
