Legal Question in Family Law in California

Inability to pay back child support.

After over a year of harrassment, I have a stipulated agreement to repay $15,000 of back child support (from 1992-94) at $500/month. (That child is now 19 years old). That began 6/1/99.

However, I am unemployed, (and actually have been since November of 1998) and have CURRENT, legally binding child support to pay ($5500/month) with current (separated) spouse. (This child is 12). Is there any possibility of relief? While I made a good living in 1998, which distorts my ability to pay, I now live on TV writing residuals and some unemployment payments at the moment, trying to maintain two households. Is there some rights of relief available? The Orange County DA (to whom ex-wife went for back child support) has been agressive, often sending out wage attachments, to three different counties, as well as EDD and Writers Guild of America(which held up residual payments for a month). What are my rights? I do have an attorney, but he doesn't seem to be an expert in family law. Thanks.

Keep in mind that your current order for support continues until you ask the court to modify it, based upon your changed circumstances.

It sounds like you need to modify both orders.
