Income & Expense

Lost my job and ex-spouse filed for modification of support based on her lower income. Her income and expense declaration clearly does not include everything. Is there an order to her employer that the court can subpoena records for accuracy?

The clerk of the court can issue a subpoena duces tecum. You can serve the subpoena, with a list of items to be produced attached to it, on her employer requesting that copies of her pay stubs be produced. You must carefully draft the declaration to insure that the propert documents are produced.
