Legal Question in Family Law in California

My Income

I am about to marry a man who has a 16 year old daughter. I would like to know if my income will affect the total amount of child support he pays his former wife each month. Thank You

Re: My Income

It affects child support only to the extent that it affects his tax status, and his takehome pay.

Often that means that child support will go down because he is placed in a higher tax bracket. If you are concerned get a consulation with a family law attorney, provide him with the information to complete a child support calculation. You may sleep better at night knowing where you stand. Good Luck, Pat McCrary

Re: My Income

The general rule under CA law is that a new spouse is not responsible for support of step children. Child support is based on each parent's monthly income and the amount of time the child is cared for by each parent. The exception is where not considering a step parent's income may result in serious harm to the child. For example, if mom has low or no income, and dad refuses to work but has an employed spouse, then a court MIGHT factor in the new spouse's income.

Hope this helps!
