Legal Question in Family Law in California

Income of spouse concerning childsupport

I am planning to marry a man who currently pays child support. Once married, will the child support be adjusted to include my income? I make more than my fiance.

Re: Income of spouse concerning childsupport

The income of the spouse is only used to calculate the taxes paid by the parent. In most cases it causes them to pay more taxes (the marriage penalty) and therefore the child support goes down. Have a family law attorney do a guideline child support calculation to be sure. In most cases the change is less than 5%. Good Luck, Pat McCrary
