Legal Question in Family Law in California

inforce support judgnent

I have a support judgment and my ''X'' quit paying. The judgment is in California and I now live in Florida. What do I need to file and do I have to be present at the hearing?

If your X continues to live in California you must enforce the order in California and it will do you no good to domesticate the order in Florida. You can get a wage assignment without a court hearing. You should also file an abstract of support judgment in the county where your X lives. To set arrears you will need to file a motion, but you will probably not need to appear at the hearing as must counties handle those motions by declaration, without live testimony and, to my knowledge, the counties that require live testimony allow telephonic testimony. You can also ask the court to order our X to pay attorney's fees and costs. If you know where your X works it would be fairly inexpensive for me to obtain the wage assignment. If your case is in Southern California you can fax me a copy of the order and I can give you an idea how to you might proceed to collect that back support. Good Luck, Pat McCrary
