Legal Question in Family Law in California

inheritance

My husband & brother in law inherited a property, my brother in law has passed away, so now 50% of it is in his estate, my husband owns the other 50%. Mu question is, I am getting ready to file for a divorce, and wanted to know what rights I had to the property? We have been married 201/2 years, and the property was inherited 7 years ago.

Barring some action on your husband's part giving you an interest in the property, in writing, you have no interest. Any property obtained through inheritance is the receipent's separate property.

Inherited property starts off as separate property, and can become community property given certain events.

Both previous replies are right on the money. Depending on what your Husband has done with the property and how or if he has used any community funds for it's advancement/appreciation, the community may or may not have any interest in the property. As previously mentioned, consult with a knowledgeable family law attorney.
