Legal Question in Family Law in California

I was injured in a serious auto accident in January of 2010. I obtained a personal injury attorney to represent me. We will be settling in the next few months. I am married. Will the settlement proceeds be mine, alone; or, will my husband be entitled to 50%?

If a personal injury cause of action against a third-party tortfeasor arises during marriage, Calfiornia treats any recovery or settlement as community property. (Fam. Code, � 780.)
