Interest on balance owed attorney

I owe my attorney a balance of approx 3500. I have been making monthly payments of 100. She now says if it is not paid in 90 days she will charge 10% interest on the balance. Can she do that? There is nothing about interest in my retainer agreement.

The maximum rate that you attorney can charge is 8% unless there is a written agreement providing for the maximum of 10%.
