Legal Question in Family Law in California
best interest of the chilfren
im the custodial parent of two young children. the childrens mom has a ''shack up, boyfriend, or fiance'' who is 1/2 way of completeing a year domestic violence program. he is diagnosed with impulse control problem as well as a.d.d. also numerous r/s orders from his two failed marriages and a protective order from the d.a. as well. ''if'' he completes this class, and ''if '' our judge allows contact at the moms visitation, aside from a piece of paper certifying completion i fill it is only fair that he be evaluated by a psychiatrist of a neutral party. i feel the childrens safety involved, mentally and physically, this is a small request. the children should not suffer or be put in the uncomfortable enviorement. i should add that for two years the mom and the person have tried any and everything to push my buttons to attempt a custody change.in fact im still awaiting her child support arrears! who will guarantee and be responsible for his actions? please advise?

You may request a psyche evaluation via an OSC hearing. It is the public policy of the state to give custody first to a parent, therefore, you may have a battle on your hands. You would be well served by obtaining representation. This is a matter for which an experienced hand in legal strategy in needed.
