Legal Question in Family Law in California

International child custody

I am a US citizen that has become pregnant by a UK citizen. We are not married and are not pursuing a relationship.

He is looking into custodial and/or visitation rights, and wanting to take he child out my care and out of the USA after the child is born.

I am having the child in California.

Can he do this? What are is his rights as a international unmarried father of this child? Also, does it matter if he is on the birth certificate? Does he have more rights if he pays child support? What are my rights as a US unmarried mother to a child who's father is from the UK?

Thank you

Re: International child custody

He cannot take the child out of the US without your consent or a court order. Before he obtains a visitation order he will have to establish paternity. Having his name on the birth certificate is not conclusive. You can stipulate that he is the father or he will have to undergo a paternity test. If he is the father, then he will have to pay child support. You have the right to receive child support and he will have the right to visit with the child.
