Legal Question in Family Law in California

Already involved in court system went throught evaluation what do i do next?

we have gone through evaluation. main conserns are of the fathers drinking. alcohol eval. states he feels that father abuses alcohol but is in partial remission. father has has 2 duis during 1st year of sons life and a third open alcohol ticket in more resent months. my son is only 3. father also harasses myself. my son has come to my home calling me foul names and saying that i was fat. father has threatened my life and yells outside my home. i feel all of this is being dismissed by eval. she states that she feel father does not have problem w/alcohol. she feel i am depressed and i am persuing thearapy as suggeste. she suggest that custody be both

joint legal & physical. visitations to be on 3 1/2 day intervals. i feel that this would be extremely

difficult on our son. with this in mind i would like primary physical with every other weekend

and some dinner visits for the father. i feel that it would stabilize our son's life a little more.

futher more she states that i have to live within 30 minutes of father which would greatly

impact our lives because we live in such a high cost area that i can simply not afford and i have

no family or support.

You need an attorney if you do not already have one. I would suggest doing an OSC to have another 730 evaluator appointed, or at least get permission to allow you to get a 733 expert to do an independent evaluation. This is too complicated of a subject to discuss on this forum. If you are located in Southern California and need an attorney, you may call me for a free telephone consultation at 818-342-8020 x1
