Legal Question in Family Law in California
No job no money
My question, Is it possible to get custody of three children in a relationship where we the father and mother have practiced shared custody, based on his refusal to support his children with the food and clothing they need on a regular basis because he is to busy spending it on his girlfriend. Also lately he has made it known that he never wanted to have a boy. He verbally told everyone at our sons IEP meeting regarding his ADHD problems in class that he felt the problem was his fault because He ''Never wanted a son''.

The issue of support is generally not considered an issue in a child custody proceeding. It may affect the outcome, but does not consititute a reason to change the current child sharing arrangement. There is much that can be done and I would suggest that you talk to a Family Law attorney to discuss your options. You can file a motion or action to set child support. This is a case that you will need the advice of an experienced family law attorney or you could make a request that would turn out worse than your current situation. Good Luck, Pat McCrary
