Legal Question in Family Law in California

Joint custody and school enrollment

My divorce judgment states that both parties have joint legal custody and ''the joint custody includes joint decisions by both parties ofthe minor's school enrollment''. My ex wife has recently moved and has changed my son's school without consulting me. Is she in contempt of court and if we go to court would a judge do anything to her for not following the court order? I have my 10 year old son on Tuesdays after school until Wednesday night at 9:00pm and every other weekend. The change of schools will probably force us to stop the mid week visitation, due to the distance away from my residence.

Re: Joint custody and school enrollment

Certainly she violated the order, and the enrollment is not valid. File for an OSC to resolve the issue or you can play hardball and file an OSC for Contempt simultaneously. The current trend of pro pers crowding the court is resulting is miscarriages of justice and against the interest of judicial economy. Please obtain representation from an experienced attorney for the sake of the child. Please call me directly at (619) 222-3504.
