Joint legal custody
My ex-husband and I have joint legal and physical custody of our 3 year old son. We have had and continue to have a very high conflict divorce. My sister has developed a new product and would like to use a picture of our son on the packaging and web site. Do I need to inform my ex about this? Do I need to get his permission? If he says no and the picture is used anyway, what are the legal consequences my sister, her company and/or myself would be facing?
I also have the same questions about having our son in commercials and/or modeling.

None. You can have your son do the photo ad. There should be no legal consequences. If your husband doesn't like it, well, tough. You have joint legal custody and when your son is in your custody you can do what you want as long as it is legal and doesn't violate his best interests. Surely, your sister would pay him for this and you can set up a college savings fund for him. Good luck and thanks for inquiring.

There is probably no requirement that you inform your ex about this decision. However, to be on the safe side, I suggest that you consult with an experienced family law lawyer, and have your custody orders reviewed, just to make certain. Experience is not expensive, it's priceless!
