Legal Question in Family Law in California

Joint Legal Custody Rights

My son's mother and I share joint legal custody, while she has sole physical custody. She wants to send him to a private school even though she lives in an area with some of the best public schools in the San Gabriel Valley (L.A. county). Also, she insists on sending him to ridiculously expensive daycare centers and asking that I pay half. I certainly want my son to go to a good school and be well taken care of in daycare, but I think she's taking unnecessary [and very expensive] measures. Legally, what say do I have in the matter?

Re: Joint Legal Custody Rights

This is hard to answer without seeing your custody order. If the order requires you to pay half of whatever she signs him up for I would go in and ask the court to modify the order. Make a showing of what the reasonable costs would be for day care and the court will likely only have you pay half of that figure and then allow her to take him to the designer day care if she pays the rest. Also, the courts generally wont make you pay for private school if public school is available but will generally allow her to send the kid to private school at her own expense.
