Legal Question in Family Law in California

Joint ownership of house after divorce

I've recently married, and my husband was married before. His ex-wife left him about five years ago, and he had custody of the children. She hasn't contributed anything to their upkeep or that of the home, but her name is still on the deeds of the house. He has also given her money, cars etc over the years, as she has no income of her own. I'm worried that, should he die, she will be able to take the house. He thinks that she won't be entitled to anything, but I think she will be able to have at least half of the house as her name is on the deed. How can we rectify this situation?

Re: Joint ownership of house after divorce

You need to see a family law attorney to clear up the title to the house. Based upon what you have told me, she owns have the equity in the house, MAYBE MORE. As the equity in the house goes up, her equity in the house goes up. Your husband dies and you are out. Good Luck, Pat McCrary
