Legal Question in Family Law in California

July 17, 2010 my husband of 14 years decided to leave. He didn't just leave me but he also abandoned his two granddaughters whom have abondanment issues already (and the childrens court gave us legal guardianship over) I am a total loss. I do not know what my legal options are. My property taxes are due and he is on the deed to the house and my only income is Social Security and he closed all the joint bank accounts and transferred them all into his name. He currently works and receives unemployment. He bought a place to live with monies that were both of ours. When he first left he asked my youngest granddaughter if we needed anything she told him food and his only response was "oh". He plans on retiring soon and how do I insure I am financially stable for myself and my grandaughters. Any advice you can give me will be greatly apreciated. Emma

Your case sounds pretty tragic and more complicated than a message board can deal with. You will need to file for divorce quickly so that you can get court orders requiring him to return the money or freeze any of the community money that he stole from the joint accounts. You should also start getting court orders regarding the payment of taxes and payments tha will be due soon. You would need to act fast because getting into court takes a while. As far as the abandoning of the grand children, you may need to modify the support amount you receive from the biological parents. They are the ones who are financially responsible for the child.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
