Legal Question in Family Law in California

Who has Jurisdiction?

Hi,

The court order was originally out ot the state of Washington. The mother lived there for about 12 years. She might have than moved to California for a short time and then moved to Las Vegas, Nevada and an unknown amount of time. She recently moved back into California, Los Angelos area.

Under the Uniform Child Custody Jurisdiction and Enforcement Act, I understand it to be that the child does not have a current home state. This would imply we could file here in Northern CA as oppossed to Los Angeles area. Is that true?

Re: Who has Jurisdiction?

No, it is not true. The State of Washington has jurisdiction. You will need to file a motion in Washington to get them to give up jurisdiction.
