Legal Question in Family Law in California

Kicking Out adult child from home

Hello,

My mother has been ''Enabling'' my 47 yr old sister for some time now. My sister has been living in her home without paying rent for over two yrs. (And on and off before that) We siblings, as well as my mother, have tried to tell her that its time ''To move on and move out''! My mother as well as my other sister verbally told her about 2 wks ago that she needed to be moved out by Nov 9th 2008. (She has been told by my mother many times prior to this but my sister doesn't take it seriously and my mother has never followed through with her demands). Consequently, my other sister and I have decided to be there Nov. 9th to enforce my mothers demands. We really didnt want this situation to come to this point, however, this is our last ditch effort to help both our mother and sister. My sister is also verbally abusive to my mother and has been for MANY yrs. We would like to know what our legal rights are to get my sister out of my mothers home. Does my mother have to give her written notice even though she does NOT pay rent? We live in Cali. Recently my sister mentioned that ''She needs 60 days notice because that is the law''. we are so saddened and upset. We could really use some advice. Thank you and God bless,

Shelby

You should contact the local police station or sheriff and see what their procedures are for removing a person who is a guest of your home.

Good luck.

As always please consult a qualified attorney before taking legal steps.
