Legal Question in Family Law in California

lack of jurisdiction

my husband filed a petition in los angeles county after only living there for 2 1/2 weeks. We have both lived in Northern California. I still do. I don't believe this is legal. What steps should I take? I was served yesterday. Can I file a petition in my county now since he filed in the wrong county?

Re: lack of jurisdiction

The proper course of action would be to write a letter to him requesting that he either change venue to the county where you lived, or dismiss the case he filed. If he reufses to change venue then file a response to the petitione and file a motion for change of venue. Request that he pay your attorney fees and costs. He should also be responsable for payment of the transfer fees.
