Legal Question in Family Law in California

I got laid off here in California. my fiance got a really good job in Nevada and we plan on getting married which means I would be moving to Nevada .. I share a now 3 year old, I have physical custody and joint legal .. Last thing I would want to do is keep him from his dad .. but i cannot find work out here for the life of me and have work waiting for me in Nevada. How would I go about this ? Any feedback would help.

The first step is to talk to dad and attempt to work out an agreement for the move and visitation. You could suggest that each of you subscribe to a high speed internet service and obtain a web cam. This would allow him to have visual contact with your son. Three old children have a short attention span. Frequent short web visits would be an the best approach. Overnight visits may be a problem until he is older. However, short frequent visits over the web cam will make these visits easier for the child. If you cannot work out an agreement then you will have to file a motion requesting a move away order. Although you do not need to provide a good reason for the move, including information regarding the reason for the move and the benefits for your son will be helpful. The court will generally send the move away issue for an evaluation. A record of the actual visits between father and son may be helpful, especially if father is not consistent with his visits. Retaining an attorney to help you in this matter will increase the probability of success.
