Legal Question in Family Law in California
Is it too late to take action still?
I posted a question a while back about my son's father getting physical with my 11 year old on August 11. You suggested an OSC requesting a temporary restraining order stopping visits should protect you and your son. Depending upon the particular county you live in and the procedure there may be an emergency screening which will bring out the problem. A lack of action on your part will place you at risk of losing your child.
I am scared....of doing anything, my son has visited his Dad since, and things have been ok...but he has a temper and it could happen again....can he be made to go to anger/parenting classes but still see his son. And have I left it too late to do something

The delay in taking action will definitely weaken you case. However, you have a duty to protect your son. You lived with him and should know the signs that he is building up to one of his temper rages. You should talk with an attorney about the situation as soon as possible. The longer you wait the more difficult your situation will get.
