Legal Question in Family Law in California

late filing of response to modification of child support

Can court still consider my response if it was filed 24 hours before court due to language barriers and refusal of petitioners employer to allow service, home address unknown and lawyer lives in different county?

Re: late filing of response to modification of child support

What happened? Did the court consider?

General rule: Court has the discretion to consider late filing, and may consider if there was good cause. Best policy to explain the problems to the court and ask court to consider. Does not matter if lawyer lives in a different county, fax and mail a copy anyway.
