Legal Question in Family Law in California

How do I get the law to act?

Back in Sept.2002 I filed a report with the P.D. because my husband hit me. Because I did not say ''Arrest him'' they did not. They said they would forward the info to the D.A. I took pictures at the time I was hit and some a few days later (the latter showed swelling and bruising). I got a restraining order. My hub had the phones disconnected (the phone company said he had made the call). My hub saw me in public and did not leave right away-he stood 20 ft from me glaring and muttering. When I called the P.D. they did nothing. While I was at work he came in the house-turned the heater valve off, took his motorcycle. Again the P.D.did nothing. I called the D.A.'s office and they said they never got anything from the P.D. I went to the P.D. and asked them why they hadn't followed up on my husband. They said because I didn't ask to have him arrested originally they didn't send anything to the D.A. Sounds the opposite from what they said before. I gave them the pictures and they said they would be sending them to the D.A. 2 months have passed and I have heard nothing. Anyway, how do I get action and get this guy who seems to think he is above the law out of my life, and arrested?

I think that you should go to court and get restraining orders against him. Then if he violates the restraining orders the police will prosecute him.

Good luck to you.

if you currently have a valid retraining order issued against this person, that should be legally sufficient to prosecute him should he violate the terms of the order. we deeply empathize with your situation and would be more than happy to further assist you legally in "prosecution" of this harmful individual if you can email us more specific details regarding our case and restraining order you currently have out on him. warmest regards.
