Legal Question in Family Law in California

Lawyer Communication Problems/Divorce

My lawyer continually says that she is trying very hard to make it possible for me to buyout the house from my spouse. However, she has never shown me any letter or document to prove what she is saying. It's been 11 months since I filed for divorce.

You need to sit down with your attorney, and discuss the purchase of the family home. Also there is no reason you cannot call the soon to be ex and ask about your purchasing the family home. You should review the potential tax consequences of purchasing the family home. The IRS code provides that you do not get a stepped up basis in the house for the money you pay to the ex spouse to buy out the house. The delay in the buyout may be a benefit to you as generally housing prices are going down.
