Legal Question in Family Law in California
He has lawyer, how do I get one, he has all money?
I am going through a divorce, and I have filed as IN-PRO-PER. Not long ago he hired a lawyer for himself. He has total control of all finances, I have absolutely no access what so ever to money. How can I obtain a lawyer? Am I not entitled to equal representation? Please send me in the right direction.

YOU DO NOT HAVE AN AUTOMATIC RIGHT TO AN ATTORNEY IN A FAMILY LAW CASE BUT THE JUDGE HAS DISCRETION TO ORDER ATTORNEY FEES FROM THE COMMUNITY ASSETS OR THE OTHER PARTY.

There is no constitutional right to an attorney in family court, like there is in criminal court. BUT, the family law code allows a judge to order that money from community property be made available for attorney's fees in situations like yours. That doesn't mean a judge WILL do this, but the relief is theoretically available. An attorney can advise you based on your specific circumstances. Many family law attorneys provide a free initial consultation. You can locate attorneys on this website, and also from local bar association lawyer referral services. Good luck!
