what is leagal age for my son to say when he wants to stop going to his dads house? he is now 12yrs old and he dosent want to go see his father any more.

Starting in January 2012, family law courts must allow children 14 and older to testify - unless there is good cause shown for them not to do so. Until then, each judge can exercise his or her own discretion as to if and how she allows input from a minor child. Some judges will allow testimony, some will interview the child in chambers, some will appoint minors counsel or order a 730 evaluation. There is a presumption in Family Law that it is in the child's best interests that he have frequent and continuing contact with both parents. A 12 year old child not wanting to visit Dad is probably not enough by itself to change the existing order. The court would probably ask your help in getting Dad and son's relationship back on track.
