Legal Question in Family Law in California

leagal &physical custody

I have full leagal and physical custody of my two daughters,,I have remarried and would like my wife to be able to have full custody in case something happens to me,,my ex-wife lives in another state and does not give any support both financially or physically. The last time my ex actually seen the girls was three years ago. My ex has also moved several times and never once has told me her new address,,

Unless your current wife is the legal parent, it may be difficult to ensure she retains custody if you pass. If bio permits an adoption, she will not have to pay support. Might use that as a lever.

You can have her relinquish custody and your new wife could adopt. There are investigation fees involved, even if you don't have an attorney, so it could cost you, in court costs, about $1200.
