Legal Question in Family Law in California

May I leave to Houston with my 10 month old son?

I am originally from Hou.,Tx. and in July 2003 I came out to CA to visit a distant aunt & uncle and their 2 sons. While I was here I met a man. He and I hit it off! When I got back home I found out I was pregnant. So he moved me, my daughter (which was pregnant also)and all my belongings to CA so he and I could start a life together. He promised to marry me and he told me he wanted lots more babies...I was estatic! I moved to CA on 12/23/03 he and I rented a house together. Things were perfect. I had our son on 02/25/04..things were good. Well, 12/12/04 (a week before x-mas) he told me he no longer wanted to be with me anymore. Now I am trying to go back home so I can be back with my family (support system) and start my life over. He had been fighting me from taking our son to TX but I feel now he feels the court cant make me stay in CA. So he has agreed for me to take our son but he would like visitation to be that he see him every 2 months for 2 weeks at a time. What is standard for a child of 10 months old? Would they let my son travel from state to state every 2 mths? We have a court date set for June so I have to wait another 6 mths. He said I have to be out of this house in 30 days. What can I do? go home?

Retain an attorney to represent you. You should be able to get a court order allowing you to stay in the house or in the alternative for him to pay support that would allow you to get a place to stay.

Then start working being able to move back to Texas.
