Legal Question in Family Law in California

Leaving joint property

I am interested in obtaining a divorce from my husband and we live in Southern California. I would like to leave and seek other residence but would it be considered abandonment of our house by me if I am the one that chooses to leave? I do not want to lose any rights to my home as we are both on the mortgage.

Re: Leaving joint property

Leaving state would not have any effect on the ownership of the home. It would still remain an owner. However, if he went to a state where your husband did not have any contacts, that is legal contacts, your new state, while it could grant you a divorce, may not have jurisdiction over your husband with respect to things like spousal support or marital property.
