Leaving Minor at home alone

My 15 (soon to be 16) year old daughter lives in Sacramento with her mother. Her mother just accepted a job offer in LA and plans to leave my daughter at the house with no supervision. She already has issues at school...not attending, poor grades, she has run away a couple of times. The mother states she will fly back occasionally to check on things, but she feels my daughter is mature enough to handle this situation.

Is this legal??

That's not appropriate. Why don't you take custody?
