Leaving The State

My boyfriend has been offered a job in another state. I want to move with my boyfriend out of state. I have one child with my boyfriend and another from a previous marriage. I have full phyical custody of that child. My ex-husband doesn't spend any time with my daughter. But has visitations setup. What legal right do I have about taking this child with me and how would I go about doing this?

If your ex has been seeing your child for less than, say, 30% of the time on a consistent basis, you should have no problem leaving. You need to see what it says in your judgment. If it says you have to give him 30 (or 60 or 90) days advance notice if relocating, that's what you do and he has to file a motion to try to stop it. If it says you need court ok, you have to file the motion. Give notice in writing, certified mail
