Legal Question in Family Law in California

leaving out of state

I am a single mother, of a 1 year old daughter, and im not married. I would like to leave to Texas to go live with my family instead because I dont feel comfortable living with my daughters father anymore because he tries to hit me sometimes, but he said if I leave with our daughter that he will accuse me of kidnapping her and that I will go to jail is that possible?

Yes it is possible. There may be no criminal charges, however, it could substantially affect your custody case. Seek the advice of an attorney. Good Luck, Pat McCrary

If he is threatening to physically abuse you, contact the police and get in contact with a local abuse center and ask for help
