legal name change

I have two children from a first marriage,I have

remarried and want to change their name legally. The

ex husband is nowhere to be found, and has not

contacted in over two years. I have sole legal and

physical custody. My question is how old does a child

have to be to legally change their name without the

absent parent's consent? Or would a judge possibly

grant a name change given the situation? Th

You can file the petition with the court for a name change. Is your current husband thinking about adoption, you have a prima facia case with not contact or support for over one year. Good Luck, Pat McCrary
