Legal Custody - School Enrollment

My ex-spouse shares legal custody of my son with me. He is five and will be six in December. We recently had a verbal agreement that he would be enrolled in kindergarten, however the Friday before school starts my ex filed paperwork to try to keep my son out of school and change custody. My son is already registered, he was registered after the verbal agreement, he starts school on Monday (should rather). Will it harm me in the courts if I place my son in school until the court hearing? I am afraid if I dont\' place him in school he will have to wait until next year.

If Monday is your custodial time, then take him to school. You should go ex-parte, as soon as possible, like tomorrow, and ask the judge for an order to take him to school. Good Luck, Pat McCrary

If he has been living with you primarily, then you should enroll him in school near you.
