Legal guardian wants to adopt grandson

My daughter died in a car accident and I have legal guardianship of my grandson. Parents not married, but father listed on birth certificate. Father has not provided any support for grandson. Can I adopt grandson without his consent? And will my grandson lose social security he draws on his mom?

In an adoption the child becomes the child of the adopting parents for all purposes. The adoptive parents become liable for the support of the child.

Adopting the child would have the advantage of cutting off the rights of the father.

Is your grandson's father locatable? It is possible he may be considered to have legally abandoned him, which means the court could terminate his parental rights. Are you his legal guardian now? You can call Social Security's toll free number to see if adoption terminates the benefits.
