Becoming a Legal Guardian

I would like to know what I would need to do to become a legal guardian for my step daughter? Do both parents need to agree or would just one do? If we do the paperwork and the mother fails to show would it be granted or put on hold?

A petition requesting that you be appointed guardian with the court. If both parents agree to your being appointed guardian there would be no trial. If mom does not agree and does not appear then you would win by default.
