Legal Question in Family Law in California

Legal guardianship of child

My 33 yr. old daughter recently died and left me custody of her child in her will. The will was written before she was married (not to the father of the baby). My question is: Do I need to go through the court system for legal guardianship or is her will enough? Her natural father is not in the picture, but her stepfather wants to share guardianship, although my daughter never expressed those wishes to me, so I would rather just be the sole guardian.

Re: Legal guardianship of child

You will have to go to court and be appointed the guardian of the the child. You may be able to do this through the probate court.
