Is it legal for a judge to accept a "gift" (a cookbook) from a respondent in the courtroom during proceedings "because the respondent is feeling so positive about himself, without allowing the Petitioner to view it first or at all?

It's unethical for a judge to receive a gift from one of the parties during the litigation, and remain the judge hearing matters in the case. You may need to file a motion pursuant to Code of Civil Procedure section 170.3 to have the judge recused.
