Legal Question in Family Law in California

legal limits of marriage

aug. 2006 got married in Reno I set up 1 credit card (1k)atm (500) although all my credit cards are compromised, used w/o authorization on web to the tune of 60+K. Had to cash 401s to pay credit cards. Is annulment the avenue to take?

Re: legal limits of marriage

Annulment may not be the appropriate remedy. While you can get an annulment through "fraud", generally, it requires that the type of fraud be something that is "vital to the relationship." Most reported cases involve sexual or procreation aspects of marriage.

Your best bet to get rid of this spouse is a standard divorce or dissolution action.

As to the credit card usage, there is nothing stopping you from reporting your spouse to to the police for embezzlement or suing him/her in civil court.

Good luck.
