Legal & Physical Custody

My husband brutually beat my 9 mo. old baby and me. There is a criminal protective order proventing him any contact with us. It has been six month now and the divorce will soon be final. He has not seen our child since the incident and is facing numerous felony charges which will result in jail time. When filing for custody, will I get full legal and physical custody of my child?

You should get sole physical and legal custody. Further you should request an order that he is to have no contact with the child.
