Legal Question in Family Law in California

legal responsibility

my granddaughter had sex outside of her marriage. She wants to stay with her husband. If she is pregnant by the infidelity, does that person have any recourse towards that child?

Re: legal responsibility

Generally, the other man has no recourse if your granddaughter was living with her husband at the time, unless her husband is sterile. There may be other issues if she were separated. She should consult with an attorney so that she will understand the implications of what she could do to give the other man an opening to claim paternity. Good Luck, Pat McCrary

Re: legal responsibility

The child is presumed to belong to husband. If paternity is challenged, then bio dad may get some visitation rights. If so, he'll also pay support.
