Legal Question in Family Law in California
I want to know my legal rights regarding divorce. Financially I am not sure what I am entitled to or what he would be responsible for. We have 5 children one of whom is now 19 but we do own 3 cars and our house. We barely make enough money now and we both work full time. He has always told me that I would loose everything, including the kids, so I have never sought out legal advice. I want to know my options and not believe everything he has told me over the years. We have been married 18yrs. I am concerned for the kids, even though that is why I have stayed for so long. But Financially I don't know if I can afford to not have his income fully.
I just want to be able to defend myself when he threatens to take it all and leave me with nothing, because he makes more than I do.

You have many legal rights. In order to properly address your specific circumstances, you really need to meet with a skilled family attorney. Any property you acquired during your 18 years of marriage from earnings is community and each party us entitled to 1/2 of the community value. You may also be entitled to spousal support and child support. If you are the primary caretaker of the children, the courts will support your role as the custodial parent.
