Legal Question in Family Law in California

Is there a legal separation?

My friend is separated from his wife since 1992, he supported her and his children, his youngest son is 24 and till now he is giving her money plus the house where she lives is paid off. Can she still get his retiring money if they get divorced? We have 2 kids and they are going to college we have been together for 14 years.

Generally, he can get the one half of the portion of the retirement that he earned during the marriage, before the separated. This is a difficult legal issue and he should dissolve the marriage as soon as possible as the issues get more difficult as time passes. Good Luck, Pat McCrary
