Legal Question in Family Law in California

legal separation law

How do you prove you are separated with out

filing legal separation with a court. My husband

and I have been married for 6 years. We started

having major problems and we decided to

separate. I am planning to file a divorce in the

next few months. More than a year ago, I moved

out and settled in a different city in a different

county and we haven't contacted each other

since and we don't won a home and our finances

are 100% separate. Immediately after my move,

I changed my address and started to go to

school. In the process of applying for financial

aide I was asked to provide information on my

husband income so they can review my case. I

told them my husband and I are separated and

we don't have any sort of communication (he

doesn't even answer my phone calls). The

financial aide office have asked me to provide

them with evidence that I am separated from my

husband so they can review my case based on

my income alone. Even thought I have no court

issued legal separation papers, how can I prove

to my school that I am separated? Would stating

my change of address be good grouds for

separation evidence? Are there other avenues

that I can take? Please help. Thank you.

Re: legal separation law

File the divorce, what are you waiting for? A "legal separation" is a court judgment the same as a divorce is. It requires the same effort, so if you know you want a divorce, just do it.
