Legal separation is it nessarry or not.
am I entitled a house that my husband was give during the prosecc of a divorce from his mother . if we are not legally separated. For the purposes of dividing property, do we need to be legally separated or not.

Property given to your husband, regardless of the status of your marriage is his separate property. There would be a community property interest in the property only if it was transmuted to community property. You should discuss the facts of your case with an attorney.
