Why are you seeking a legal separation rather than a divorce?

Re: legal seperation

1. In SC, a legal separation can be accomplished via a separation agreement or by filing an action with the Court.

2. Fathers have equal rights under SC law to their children, and I have personally represented many fathers who have obtained custody of their children.

3. I am not admitted in CA, so I will have to defer to the attorneys there on this question.

4. Child support in SC is based on our Child Support Guidelines, which take into account the gross monthly incomes of both parties, work related child care expenses, cost of health insurance for the child, among other factors.

5. You can certainly try to represent yourself in any family court action, but it is generally a bad idea -- ranging from pretty bad to terrible, depending on the facts of your case.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.
