I'm not legal in the united states and I want to leave my husband he' s legal here in the united states can't he take my son away from me

Your immigration status should have no bearings on your child custody matters. The only thing that might arise is if your immigration status is tied to your husband's citizenship, then you may be deported once you divorce. I would speak with an immigration attorney to make sure that your immigration is not affected by getting a divorce from your US citizen husband.
